Asperiq is committed to safeguarding the privacy and secrecy of our website visitors, service users, individual customers and customer personnel. The processing of your personal data forms an important part of our provision of products and services. We appreciate the trust you place in us when providing us with your personal data, and consider your privacy and secrecy an essential part of the products and services we offer.

This policy applies where we are acting as a data controller with respect to the personal data of such persons; in other words, where we determine the purposes and means of the processing of that personal data.

We use cookies on our website. Insofar as those cookies are not strictly necessary for the provision of our website and services, we will ask you to consent to our use of cookies when you first visit our website.

1. Data collection

1.1 In this Section 1 we have set out the general categories of personal data that we process and, in the case of personal data that we did not obtain directly from you, information about the source and specific categories of that data.

1.2 You may provide us with information about you through our websites or in other contacts with Asperiq. We may also obtain such data from our authorized agents, resellers and partners, your employer, and other third parties.

1.5 We may process data enabling us to get in touch with you ("contact data"). The contact data may include your name, email address, telephone number, postal address and/or social media account identifiers. The source of the contact data is you and/or your employer or our agents, resellers or other partners.

1.6 We may process information contained in or relating to any communication that you send to us or that we send to you ("communication data"). The communication data may include the communication content and metadata associated with the communication. Our website will generate the metadata associated with communications made using the website contact forms.

1.7 We may process data about your use of our website and services ("usage data"). The usage data may include your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views and website navigation paths, as well as information about the timing, frequency and pattern of your service use. The source of the usage data is our analytics tracking system.

2. Purposes of processing and legal bases

2.1 In this Section 2, we have set out the purposes for which we may process personal data and the legal bases of the processing.

2.2 Operations - We may process your personal data for the purposes of operating our website, services and business. The legal basis for this processing is our legitimate interests, namely the proper administration of our website, products, services and business.

2.3 Relationships and communications - We may process contact data, and/or communication data for the purposes of managing our relationships, communicating with you (excluding communicating for the purposes of direct marketing) by email, SMS, post, fax and/or telephone. The legal basis for this processing is our legitimate interests, namely communications with our website visitors, service users, customers and customer personnel, the maintenance of relationships, and the proper administration of our website, services and business. 2.4 Direct marketing - We may process contact data for the purposes of creating, targeting and sending direct marketing communications by email, SMS, post and/or fax and making contact by telephone for marketing-related purposes. The legal basis for this processing is either your consent or, if no consent has been obtained in the specific circumstance, our legitimate interests, namely promoting our business and communicating marketing messages and offers to our website visitors and service users. 2.5 Research and analysis - We may process usage data for the purposes of researching and analysing the use of our website and services, as well as researching and analysing other interactions with our business. 2.6 Security - We may process your personal data for the purposes of security and the prevention of fraud and other criminal activity. The legal basis of this processing is our legitimate interests, namely the protection of our website, services and business, and the protection of others.

2.7 Legal compliance and vital interests - We may also process your personal data where such processing is necessary for compliance with a legal obligation to which we are subject or in order to protect your vital interests or the vital interests of another natural person.

3. Providing your personal data to others

3.1 Your personal data held in our own databases. Each Asperiq company is generally responsible for marketing, sales and customer relations as well as market specific services on its market.

3.2 Asperiq may share your personal data: (i) between Asperiq entities; (ii) with Asperiq authorized agents, resellers and partners, for the purpose of distributing product and service offers and other communications to you; and (iii) with other business partners for the purpose of distributing product and service offers and other communications to you or for research and development purposes; (iv) in connection with the sale or transfer of a Asperiq’ entity or its assets; (v) as required by law, for example in connection with a government inquiry, dispute or other legal process or request; and (iiv) when we, in good faith, believe that disclosure is necessary in order to protect our rights, for example in order to investigate potential violations of our terms and conditions or to detect, prevent or disclose fraud or other security issues.

3.3 The Asperiq-entity being the data controller of your personal data will, as a general rule, only disclose your personal data to a third party if it has received your consent to do so. However, we may share your personal data without your consent, unless we consider your consent necessary in the individual case or your consent is required by law, in the following situations: (i) situations in which disclosure is required by law; and (ii) situations in which disclosure is necessary for the purpose of a legitimate interest pursued by Asperiq (for example in order to protect our legal rights, as described above).

3.4 We may also disclose your personal data to our cooperation partners, suppliers or subcontractors insofar as reasonably necessary for the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

3.5 We restrict access to your personal data to Asperiq’ employees and partners, agents, reseller and suppliers who need to use the information in order to process it on our behalf, and who are contractually required to keep your personal data secure and confidential. We aim to choose the option for data processing services that best safeguards the integrity of your personal data towards any third party.

3.6 In addition to the specific disclosures of personal data set out in this Section 3, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise, or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.

4. International transfers of your personal data

4.1 In this Section 4, we provide information about the circumstances in which your personal data may be transferred to a third country.

4.2 Information that we collect may be stored, processed in, and transferred between any of the countries in which we operate, and may permit our agents, resellers, suppliers and subcontractors to do so, in order to enable us to use the information in accordance with this policy. It is Asperiq’ policy to comply with the applicable laws, rules and regulations governing privacy and data protection in each and every country where we operate. Where necessary, we will adjust our processing of your personal data as described in this policy to ensure legal compliance, for example by not permitting transfers to a country that is designated as a third country under EU data protection law and/or Swiss data protection law (as applicable) or benefits from an adequacy decision under EU data protection law and/or Swiss data protection law (as applicable).

5. Retaining and deleting personal data

5.1 This Section 5 sets out our data retention policies and procedures, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.

5.2 Personal data that we process for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes. If we have not obtained your consent to the processing, the data will only be retained for as long as such a period of time as permitted by law.

5.3 Asperiq endeavours to only process personal data that is adequate, relevant and not excessive in relation to the purpose for which it has been collected. We aim to anonymize your personal data when a function or service can be achieved with anonymized data. If we combine anonymized or non-personal data with your personal data, it will be treated as personal data for as long as it remains combined.

5.4 Notwithstanding the other provisions of this Section 5, we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person.

6. Security of your personal information

We will take reasonable technical and organisational precautions to prevent the loss, misuse, or alteration of your personal information. We will store all the personal information you provide on our top secure servers. You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.

7. Your rights

7.1 Your principal rights under data protection law are:

  1. the right to access - you can ask for copies of your personal data;
  2. the right to rectification - you can ask us to rectify inaccurate personal data and to complete incomplete personal data;
  3. the right to erasure - you can ask us to erase your personal data;

8. About cookies

8.1 A cookie is a file containing an identifier (a string of letters and numbers) that is sent by a web server to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.

8.2 Cookies may be either "persistent" cookies or "session" cookies: a persistent cookie will be stored by a web browser and will remain valid until its set expiry date, unless deleted by the user before the expiry date; a session cookie, on the other hand, will expire at the end of the user session, when the web browser is closed.
